Legal Question in Family Law in Maryland

I want to file a divorced with my husband. He is a drug addicted with anger issues. My 3 children are in foster care due to this issue. We are separated will this effect my children and the upcoming court case if i filed for a divorced.

It may assist your case if you file for divorce. However, you have to follow through and actually divorce your husband and keep him away from children. I'm quite sure the judge and CPS will monitor the situation for quite a while. So, doing this for window dressing won't help in the long run.
