You file a petition for custody in the circuit court in your county and ask for a pendente lite hearing, which means a preliminary hearing while the case is in process. This is a legal pleading usually crafted by an attorney. If the other parent is going to fight you you will be wise to retain an experienced family attorney who knows how to properly prepare a case to give you the best chance of success. If you income qualify you may be able to get a pro bono (free) or reduced fee attorney to represent you through your county bar association.
