Grandparent Custody

I am the grandparent of 2 girls. I was awarded temporary custody of them for 12 months. They were 3-1/2 years old and 3 months old when I got them. This was due to my son and his wife and their herione addictions. This happened 3/1/04. The mother has not been heard from since. My son appeared in 11/04 to start a treatment program and the process to get custody of the girls back. He was awarded visitations in 4/05 and ordered to pay child support to me. I had filed for permanent custody in 2/05 and the case will be heard next week. He is fighting this. My son cannot drive due to MVA violations and barely makes enough money to survive on his own. He has previous criminal records in Maryland and Virginia. How likely is it that I will lose the girls ?

There is a strong presumption in custody cases in favor of the parent. But if the court thinks that it is in the best interest of the children that they remain with you, and that your son is incapable of properly caring for them, you have a good chance.
