Legal Question in Family Law in Maryland

May I ask the immigration status of my child's father in my discovery? I know that it's not a factor in determining child custody, but he threatened may times before to take the child away with him to his home country. He also told me that he was leaving the States in 5 yrs to stay in his country of origin(that was about 3yrs ago). He's filed for sole custody though the child has been with me since birth and is one and a half now. I'm in the process of getting a new lawyer, and only have a limited time to send my answers to his questions and send my questions for him to answer. Thanks for your time.

Yes, it would be a permissible question to ask the child's father in a custody dispute his immigration status.
