Legal Question in Family Law in Maryland

I have had my kids for a week & they been living with their dad & i pay child support but im goin to keep them... Can i do that? Cuz before the cops said they cant do nothing cuz im there mom & tne father doesnt have custody.

Who has custody? If neither of you has court-ordered custody, then you each have equal rights to the children. If a court order is in place, you must not violate it. If you do, you not only hurt your future chances for custody, but you risk going to jail. Bad idea.

If there is a court order outstanding, you must comply with the court order. Otherwise, you may be held in contempt. If the court holds you in contempt, the court may modify your visitation schedule to take into consideration your contempt. Yes, you may be placed in jail. Therefore, if you want more visitation or custody, the best thing to do is to file a petition to modify custody/visitaiton.
