Legal Question in Medical Leave in Maryland

Schedule changes

I work in an union steel mill where FML is a frequently used by staff. The company came out and stated that all employees on FML will be displaced to evenly distribute FML participants on four scheduled turns. I understand their stand in this situation for those who abuse it, but I used FML one time this year. (involving only two work days) I feel that I am being discriminated against and being lookded at as a whole and not an individual case.

Re: Schedule changes

It is a violation of the FMLA for an employer to take adverse action against an employee for taking that leave. It is important to remember that the FMLA is a protective statute. It protects your right to take leave and prohibits employer mistreatment of you for taking that leave.

You should probably discuss this with an attorney. If you would like to discuss this with me, I can be contacted at [email protected].
