Legal Question in Civil Litigation in Maryland

Assault

I was injured in a confrontation between my husband and the owner of a pizza place. The two exchanged heated words and it resulted in the computer screen getting knocked off the counter by my husband. I sent my husband out of the store and at this point the owner grabbed my arm and would not let go. It resulted in several bruises and muscle injury to my arm that was put in a sling at the hospital. Most tell me if I press charges he will press distructions of property charges against my husband. The police comfirmed the screen and system still work. Is it worth prusuing this or should I chalk it up to being the innocent victim of two men who can't control thier tempers? Seems wrong he should get away with hurting me when I did no wrong. It was also traumatic for my 6 & 9 year olds to see their mother being assaulted. Just want to do whats best for all but feel violated none the less.

I think you have a valid assault claim against the owner, and it might be worthwhile to see if he has insurance coverage for this. While there may be no permanent damage thankfully to your arm, it was serious enough to require a hospital visit, a lot of pain, and emotional trauma to your children. You are right - it is wrong for you to suffer because of two volatile men. Your friends are right too, he may try to press charges against your husband if you sue him. What did the police say? Are they pursuing your husband? You have the right to recover for your damages, but it may led to increased aggravation for your husband. If your husband is in trouble anyway, then. . .

If you haven't, take pictures of the bruises. Have your children shown any signs of distress since the incident? This may be a judgment call on your part. Weigh the potential trouble this may cause your husband against the damage you and your children suffered.
