Legal Question in Health Care Law in Maryland
Can a medical corporation be formed in Maryland in which some of the shareholders are not doctors?
1 Answer from Attorneys
By "medical corporation," I'm assuming you mean a professional services corporation for the provision of some type of licensed care? If so, the particular board for each type of regulated care specifies additional rules on practicing through a corporation. For instance, a corporation of physicians may have stockholders who are doctors in this state, doctors licensed elsewhere and even partnerships or other corporations who are engaged in the same type of medical care. The bylaws may further restrict stockholders.
Before forming any type of professional services corporation one is wise to both contact the governing board and seek competent legal advice.
