I am 38 years old.
Can my husband apply /submit I 539 ( application for H4 dependent visa) without my consent and signature?

I-539 is his application, not yours. However, as an H4 dependent, he is dependent on you maintaining H1B status, and therefore, he will need documentation from you proving that you are in a valid H1B status.
