My spouse is a LPR. my son and i are living in Jamaica and i want to know if we should come to the US can my spouse file for adjustment of status to allow us to stay in the US until he files for us? If so will my son be able to attend school while the process is going on? How long does this normally take?
1 Answer from Attorneys
You will become eligible for adjustment of status only when your spouse becomes a USA citizen, or your priority date is current and you are in the USA lawfully. If he hadn't filed any petition for you yet, as a spouse of a permanent resident, you are facing 4-5 years of wait.
