You can apply to change status to another non-immigrant status while in USA only if you are currently in a valid status. Generally, a person can't apply for a change of status after their previous status had expired.

As stated by the other attorney, you need non-immigrant status order to obtain new non-immigrant status -- without leaving the U.S. If you haven't been out of status for more than 180 days, you could travel overseas and apply for the new non-immigrant classification. But if you are here out of status for 180 or more days, departing can be a problem.

Otherwise, depending on your qualifications, if you're out of status for less than 180 days you may be able to apply for permanent residence through an employer. But, again, this depends on your skill level.

Note, most out-of-state attorneys can legally help you because we are permitted to practice federal immigration law outside of our state of jurisdiction. Please feel free to contact me for a free initial consultation.

Sincerely,

Michael A. Harris, Esq.
