Legal Question in Insurance Law in Maryland

diabeties and driving

I would like to know whose fault is it if an elderly man did not take his medication for Sugar Diabeties and blacked out and ran a stop sign and hit my vehicle.

This man caused $4000.00 worth of car damage to my car, not to mention the damage to his car. My car was in the shop for a month. My eleven year old child was in the car when the accident happened. We both were wearing seat belts.

A driver has a duty to act "reasonably" at all times. If a driver fails to act reasonably and causes injury and/or damage, then that driver is generally liable under tort law in Maryland. However, there are many variables that can affect the result. If you have not done so already, you should contact an attorney who practices in this area of law. In particular, negotiation with insurance company adjusters is generally better left to your attorneys, who are practiced at such negotiation.

If he was negligent in not taking the medication, and this caused the blackout, it would be his fault, but there could be complicating factors. See an experienced personal injury lawyer (we handle these cases in MD, DC, and VA).
