Can I reprint song lyrics and have it published in a hymnal?

If you are copying the lyrics and republishing it, then that would be considered copyright infringement. This is because someone owns the rights to the lyrics and you are infringing on the author's exclusive rights to reproduce the lyrics. However, depending on your use, you might have a fair use defense. This defense is based on four factors that a court uses to determine if an otherwise infringing use is permitted. There is no black and white line to this analysis, and it doesn't prevent someone from suing. To play it safe, I suggest you not do this unless you get permission from the owner of the lyrics.
