Legal Question in Employment Law in Maryland

Credit Discrimination

If you have the necessary qualifications for a job but when your credit report was pulled it was negative. Can a company deny you employment based solely on your credit report? He liked everything about me he was concerned about my credit history. Although there were good reasons for the way it was which I could prove to him. And he did ask me if I was able to provide him with proof. He never gave me a chance to prove it nor did he ever contact my previous employer which makes me feel his decision was based solely on my credit report. Can ho or the company legally do this????

Re: Credit Discrimination

If your credit report is relevant to the job - for example, if the job requires handling money - then it can be used as a criteria for hiring. If not, then it could be illegal. Also, there are several rules regarding notice and opportunity to explain when a credit report is used. These are part of the Fair Credit Reporting Act.

Good luck.
