Legal Question in Personal Injury in Maryland

Accident Involving UPS truck

I was in an accident with a UPS Truck in which my ankle was severely injured. They have claimed liability for the accident. As a result my ankle now functions at 30% mobility. Permanency has already been established. Future surgeries are a more than distinct possibility. My lawyer is urging me to settle for 275000. I do not know if settling is what is best for me or if it is best for my lawyer.

There are many factors that go into the evaluation of a claim. I have seen seemingly similar cases tried before juries yield markedly different results. You left far too many facts out of your summarization to enable another lawyer to tell you if settling for that amount is wise. If your lawyer hasn't already laid out all of the reasons s/he thinks that $275000 is a fair settlement, ask him/her to do so. Remember, since the lawyer's fee is a percentage of the recovery, if s/he thought the case would yield a lot more at trial, you'd be getting different advice. You might find out if your lawyer has solicited opinions from colleagues and if not, urge him/her to do so.

You need to sit down with your attorney and discuss your concerns with him or her. If you believe you deserve more discuss this with your lawyer, and listen to your lawyer's explanation. He or she has been working on the matter with you. You chose your attorney out of many. Now, you should feel comfortable discussing your current concerns and demanding a reasonable explanation on the settlement offer.
