I acquired an attorney after an accident that wasn't my fault. it's been 5 days and I don't feel as though he's doing his best. Can I "fire" him and get someone else?

You ALWAYS have the right to choose your own counsel. However, the law provides the attorney with the right to lien any recovery you make in the amount he expended on your case in those 5 days. In other words, the attorney will get paid for his 5 days of work whether you fire him or not. I would recommend relaying your feelings to the attorney so you can find a way to work with each other before I would recommend going attorney shopping. However the attorney MAY be entitled to compensation. If you are looking for another attorney you should make this clear to any prospective attorney that you may hire.

Of course, you can fire the attorney. However, read your contact to determine his compensation. If he was just hired 5 days ago, he may not be entitled to much. However, his rights are outlined in the contract. Also, it's only been 5 days, you may consider scheduling an appointment with him to discuss your concerns.
