If he is served with the suit papers, he'll have to follow the instructions of his attorney. The suit papers should be immediately turned over to the auto insurer who covered the vehicle at the time of the accident. They will assign an attorney to defend your friend's son. It may be that the case will be settled before he has to participate, but he may be called for a local deposition if liability is in dispute (i.e., if he claims he wasn't at fault). If there is a dispute as to who's at fault, he may be required to attend the trial if it goes that far.
Re: civil lawsuit/auto accident
The automobile insurance company, if there is one, should have been notified at or around the time of the collision. If a timely report to the insurer was not made, this could be problematic.
If there is no insurance in effect at the time of the collision, legal representation should be obtained immediately. Once served, there are time periods that apply as to responsive pleading and other matters.
He may need to return during the suit to respond to matters that may arise during the course of litigation.
Contact an attorney to discuss this matter in person, do not delay as a judgment can be costly.
