Son injured in School

My son was injured during recess in school and broke his leg. Is the school liable and are they insured for this matter?

In order for the school to be liable you must show that they were negligent and that their negligence was the cause of the injury. Essentially there is no liability were an accident occurs. You should speak with an attorney to determine whether you have a case.

You don't mention how your son's accident occurred. The school may be responsible if their negligence was a precipitating cause ie. if their was inadequate supervision for example.

If another student precipated the accident, his family's homeowner's insurance may provide some benefits.

If your son was the cause of his own injuries he may not be able to recover damages...
