Maryland law has a "disclosure and disclaimer" statement that is used when selling residential property. The Seller has the option of giving a detailed list of the condition of various items or they can generally disclaim and list only hidden defects. Generally one needs to disclose "hidden" defects. Smoking has not, to my knowledge, been considered a "hidden" or "latent" defect.
If you are listing property through a realtor you may wish to ask your agent about the property condition and what to disclose.
While not a substitute for specific legal advice, I hope that this general information helps.
