If I'm a 20 year old passenger in the car driven by a 20 year old driver, can i be charged with Possession of alcohol if the empty beer cans were on the floor. The empty cans were not on my person nor was the car mine. I was simply a passenger

Anyone might be charged with a crime, regardless of whether he or she has in fact broken the law. Whether the state has proof beyond a reasonable doubt that you possessed alcohol depends on whether a judge believes the state's evidence over whatever evidence you might decide to present. Generally, the driver will bear more responsibility for contraband than a passenger.
