Legal Question in Traffic Law in Maryland
Can an Charles County Sheriff in Maryland (or any police officer) search the trunk of your vehicle, without consent, if he see's a weapon laying on the back seat. This happened to me. Note-- they didn't charge me with having the weapon.

Whether the police may search depends on whether they have probable cause. A court would decide in a motions hearing prior to trial whether they did based on the totality of what the police knew at the time of the search. Generally, courts have given the police a lot of latitude, particularly in cases involving automobiles.
