Legal Question in Traffic Law in Maryland
MARYLAND
I was driving and was pulled over and given a ticket for using a mobile device while driving. I agreed with the officer that I was holding the device but was not using it, the device actually wasn't even turned on. Can I be given a ticket for simply having a device in my hands even if its not turned on?

Yes, you may be charged, because anyone might be accused, regardless of whether he or she has in fact broken the law. The court will decide whom to believe between you and the State.
