How do open an estate claim? My sister is trying too take over my mother's house by offering me $ 5,000 dollars. I know that's not fair and would rather sell before excepting that amount.

You should hire a lawyer to negotiate a higher price. I'm quite sure the $5,000 is just an initial offer.
