If you are talking about a suit for negligence in the court system, your suit had to be filed within 3 years, so you are too late now. Your question came in under the workers' comp category, suggesting your husband was hurt on the job. If that is the case and he filed his workers' comp claim within 2 years for any benefits, he might still have the right to pursue a claim for permanent disability, depending on when he last received benefits.
