Legal Question in Workers Comp in Maryland

How to get quick approval

I was injured in Dec 2006 . It takes 5 to 6 weeks to get approval for ay test or teatment. Right now therapy for neck was ordered 7-06 and I cant get anyone to approve it.

Out of 9 months of being injured 4 months has been waiting for approvals. Shoulder surgery is on hold waiting for outcome of neck treatment. Ins Co has called before to authorize treatment after I notified them this time lawyer says workmans comp is waiting for the doctor to call- doctor wont call he says it is up to the insurance co to call. It has taken me 4 weeks to get that answer from lawyer. what ca I do I am living in pain . I am afraid more damage is being done to my injuries. Prior to this I had some movement in may arm now I have none. I am afraid to move it because of the pain,

I hired attorney in Feb, was awarded workmans comp. money but never received ay ( dont know why) I have filed for ssd and ssi on my own (asked attornies advice nver got any)

Applied to state for help.

I have sent numerous emails to attorney and the only time I heard from him was when I apparently iritated case manager by sending her an email requesting a check to be reissued because it was stale dated by the time I got to cash it.

My lawyer yelled at me for this.

Re: How to get quick approval

The first thing you should do is try to schedule a meeting with your attorney to discuss these issues. If the compensation carrier is dragging its heels on approving treatment, ask him to request an emergency hearing before the Commission.

As to the award you say you received in February, if the carrier hasn't paid it they are subject to penalties, so something doesn't add up here. You need a candid explanation from your attorney as to what the problem is. If you don't get a satisfactory response, perhaps you need a new attorney.
