I had a workers comp claim and a 3rd party claim in 2003. Received an award from workers comp. in 2005 and settled my 3rd party claim shortly after. workers comp agreed to take a 1/3 of the money and myself and attorney received the other 2/3. My share of third party claim has a lien attached for future payments from WC. My question is this. I would like to file for worsening of condition. If i go to a doctor for my injury i have to pay out of pocket as per the lien .Should i just file before doing anything ? is this a tricky situation?I did leave the case open. Thanks Brad

Since you have five years after the last payment to file for an exacerbation, you should see if the doctor supports your claim before filing. Without medical support, you will not be successful before the WCC.
