Legal Question in Workers Comp in Maryland
workmens comp and intermittent family leave
I am on workmens comp for 4 hours per day and work the other 4 due to a job related accident in Feb 09. I am getting steriod injections and PT. My employer is saying I need to apply for intermitt family leave. Why do I need to do this? How does this benefit me?

Re: workmens comp and intermittent family leave
You are in a status known as temporary partial disability, apparently because your physician has determined that you are only able to work half time now. Whether or not what your employer is proposing would benefit you depends upon the nature of the benefit provided by the leave program. You should discuss this with your h.r. person at work or whoever performs that function. The workers' comp carrier is obliged to continue to pay you the disability benefits until they get a medical opinion that says you are no longer restricted--perhaps they have that and that is why they are offering you the leave option. If the family leave is without pay, obviously you are better off with the status quo, and may have to seek a compensation hearing if your benefits are terminated.
