Legal Question in Bankruptcy in Massachusetts

Bank accounts and bankruptcy

I'm considering bankruptcy. My name is listed second on my grandmother's bank account. Could creditors put a lein against my grandmother's account? Could my grandmother's bank account be effected in any way?

Re: Bank accounts and bankruptcy

If you could walk into the bank and withdraw the money from your grandmother's account, then she will probably lose everything in the account if you file for bankruptcy. If you take your name off the account and then file, she will also be at risk.

You absolutely have to talk to a lawyer to help you with this. If you cannot afford one, ask Legal Aid for help. Most bar associations also have a panel of lawyers willing to work for a reduced fee.

Good luck!
