Legal Question in Civil Rights Law in Massachusetts

Civil law suit regarding a debt

Hi, I was served papers to respond to 3-questions to a lawayer & to the local court with a case number regarding a prior debt from sears. I answered them myself I agreed to my name & address and but denied the debt amout. Now there are sending me a large group of interrogatory questions (very in debth) as well a request for documents & request for admissions. Are these required to be filled out, and also it says they need to be filled out in such time as required by the court but these requests are from the collection company. Will I be in default if I do not answer the questions. I want them to prove discovery.

Thank You for your help

Re: Civil law suit regarding a debt

It sounds as though you were served with a Complaint. It also sounds as though you somewhat successfully prepared an Answer.

The plaintiff has now served you with requests for discovery, including interrogatories, request for production of documents, and request for admissions. You must be extremely careful in answering these requests. You should also be aware that you must respond to these requests within a certain time frame.

You are entitled to request similar discovery of the other side. The court can compel both of you respond to the discovery should either of you fail to do so.

Depending on the amount of debt in controversy here, you are well-advised to speak to an attorney.
