why am i being charged and cannot afford an attorney and under mass law ''if i cannot afford one one will be appointed for me ''

Without more information about your situation, I cannot be of much help. However, you should know that you are only afforded an attorney in a criminal matter (and certain other limited circumstances). Even then, it must be determined that you are within the state's income guidelines.

The ability to get a lawyer has NOTHING to do with whether or not you are charged with a crime. If you can't afford an attorney, ask for one.

Each state has slightly different rules on appointment, but if you don't fill out the form or ask, you won't get one.
