Smoking and alcohol

Are there any laws that prohibit excess smoking and drinking of alcohol in a two family house, when there is a two year old child living upstairs?

There are laws a variety of laws that might apply depending on the context of the problem. It is unclear from your question the precise relationship of the parties. On condominium situation gives rise to a very different situtation than a landlord tenant or tenant v. tenant dispute.

For example, there are laws against maintaining a nuisance. There are other laws against interfering with a tenant's quiet use and enjoyment. Condominiums also have rules, regulations and agreements that should not be violated.
