Legal Question in Construction Law in Massachusetts

time I must warranty construction work in Massachusetts

My company built a sun porch in 2001.

Recently leaking in one corner was found to have caused rot in the floor and small knee wall. It has been leaking for some time, and could have been repaired much more easily had we been informed. I recently spent time and materials repairing it and feel I should be paid at least partially for the extra work. Homeowner's Insurance will pay, but say they will sue me to recover their payment. Do they have recourse after all this time?

Based on the limited facts presented; generally, if the cause of the damage was due to your company's defective work, it will be difficult to recover the cost of repairs from the owner. The insurance company is subrogated to the owner's rights.
