Cancel a gym membership

Hi,

I have been attempting to cancel my

gym membership. I recently moved

my place of employment more than

25 miles away from the nearest

health club. In my contract it

states, ''If you move either your

residence or your place of

employment more than 25 miles

from any health club operated by the

seller or a substantially similar health

club which will accept the seller's

obligation under contract,'' then you

may cancel. I sent my request to

cancel in writing due to my relocation

of employment. They sent me back

a letter requesting proof of my

relocation. I sent them the

necessary proof of relocation. I just

received a second letter from them

stating that my request for

cancellation cannot be honored at

this time. But there is no reason! I

have been in agreement with the

contract this whole time, made

payments on time, and it seems as

though they are not playing by the

rules. What are my options at this

point? Should I attempt to contact

them and ask for a reason? Can I

stop my automatic withdrawal

payment at this point? I don't want

to go to collections or be sued! Help!

You can report this to the attorney general's office. Send them a consumer protection letter per 93A; if you are paying monthly, then stop. You can be sued, but you have a defense.
