Collection of airline ticket cancellation refund
I got an airline ticket cancelled in December 2004. I was told that the refund would be credited to my credit card in 3-4 weeks. I had to pay a penalty for the cancellation upfront. The penalty check got encashed a few days later. However, the refund never came. I forgot to check my credit card statements and was unaware of the missing refund till September this year. I contacted the travel agent, who said that the airlines was responsible for the refund. I called the airlines, who told me that the ticket was a bulk ticket and the travel agent was responsible for refunds. The airlines also told me that the ticket was never sent in for cancellation and they did not receive any cancellation penalty from the agent. I went back to the travel agent. He was very rude to me, used obscene words, threw me out of his office and almost hit me. What remedies do I have to get my money back?

1. Check with the Attorney General's consumer protection office to see if they have an interest or ongoing investigation.
2. Call "Help me Hank" or one of the other consumer help people in the media.
3. Send a consumer protection letter, certified return receipt, "pursuant to Mass. General Laws Chapter 93A" to the agent and the airline (resident agent information at the corporation division of the MA Sec. of State website (mass.gov), saying what happened and what you want them to do. If they do not respond or respond with an inadequate offer, you can sue and get double or treble damages and attorney fees.
4. Sue them on contract and unjust enrichment grounds. Or wait 30 days after sending the above letter and then sue them.
