Legal Question in Credit and Debt Law in Massachusetts
''Civil'' arrest warrent for debt
I am a disabled woman who uses a motorized wheelchair. My only income is from Social Security disability. I have been permanently disabled for 20 years at this point. In the past I have tried twice to work with debt reduction firms to pay off the debt. That's when I found out that the creditor is NOT obligated to work with the debt reduction firm, as was the case when I tried twice to payoff the debt. Can I work out a payment plan with the creditor prior to going into court KAP

A debtor is certainly free to enter into a " work out" agreement with the creditor for the purpose of discharging a debt.;)

You may be better off going to court and explaining your situation to the judge. At that point the judge may find that you have "no present ability to pay" and will tell the creditor to basically go away. In a year, they might set up a date again to see if anything has changed. If not -- they'll have to go away for another year, etc.
