Legal Question in Credit and Debt Law in Massachusetts

I'm a member of a three unit condo and a member of the trust, in short, one member of the trust didn't pay part of the monthly dues owed, do the remaining two trustees have to include this third Trustee in a vote as we have the majority...it seems like a waste of time to include the third trustee as this trustee will not vote with us. Is this proper or not? Do we have to formally include the third Trustee prior to taking action?

I don't believe that he or she loses rights simply because they are in arrears. What you NEED to make sure that you do is speak to an attorney to make sure that you comply with the condominium super-lien statute. Please feel free to contact my office should you have any questions at all.
