Legal Question in Criminal Law in Massachusetts

Caught tresspassing & possession of Class D. Innocent of second charge.

I am 17 years old. I was parked in a nature area at 9:00. It was dark and I failed to notice the signs that said park closes at 8:00. A Cruiser Blocks me in. Two officers, neither in uniform, come to the car. We are told to put our hand on the dashboard. They smell weed and tell us to get out of the car. Then they pat us down and without warning search our pockets. On me they find nothing, on my friend they find less than .2g. marijuana. We are put into handcuffs, the officer accuses me of having more on me and searches the car, saying he has probable cause. He keeps accusing me and I keep saying I don't know where anything is. They find a pipe my friend left under the seat. What a great present. They take my license tell me that if they wanted they could take the car, arrest me, I'll lose my license, but instead I am going to be summonsed for possesion of a class D and tresspassing. I feel my civil rights have been violated, I wasn't doing anything and now I'm in a lot of trouble. Please Help.

You should retain a criminal defense lawyer to represent you in this case. You may have good grounds to file a motion to suppress. Even if this motion does not prove successful, a good criminal defense lawyer can negotiate a plea bargain that does not result in a convition or the loss of your driver's license.
