Legal Question in Criminal Law in Massachusetts
Clearing an Arrest Record
In 1997 I was falsely arrested for "Distrubance of the Peace" and my case was subsequently dismissed. However I still have an Arrest Record. How can I get this arrest record cleared? It's quite embarassing, I had a problem when applying for my apartment and had to explain what had happened.
Thanks!

Re: Clearing an Arrest Record
In Massachusetts it is illegal for a landlord or employer to ask about arrests. They can only ask about convictions. If the employer found out about a dismissal from some source other than you, then the person who released this information probably committed a criminal act. If so, you should report this to the police.
