Legal Question in Criminal Law in Massachusetts
shoplifting
If someone is caught shoplifting for the first time, (no prior arrests or charges), and is not immediately arrested, but is told there is a good chance that charges will be filed, and that they may have to appear in court, what is a wise course of action at this time? What might happen? Would it be necessary to have an attorney if they were requested to appear in court? Where might we obtain more information regarding a matter such as this?

When you go to court ask to speak with the Asst DA and see what he/she is willing to offer you on a plea. You should get a Continuance without a finding (CWOF) for 90 days. If you stay out of trouble for 90 days the matter is dismissed and you will have no convictions on your record.
