Hi, My Uncle has been convicted of his 3rd offense of OUI, in Ma. He is a R.I. resident.We are told he has to serve a min. of 150 days in a county jail mandatory. We have another attorney who states, as a non resident, he may serve his time in an approved rehab facility in R.I.. My question is this; should we secure the top attorney in this field to help get my Uncle to rehab. Or does it not matter who we hire, as its mandatory,period? my uncle is wealthy and the family..they have kept this hidden. my uncle is seeking help. please can you offer assistance.

It is the court that makes the decisions about alternative incarceration.

This issue must be raised in court. The issue is not one of residency; it is where the crime was committed. This is not especially complicated.
