Legal Question in DUI Law in Massachusetts

OUI Massachusetts

I was arrested in 1987. The disposition was continue without a finding. Do I need to disclose this if the questions is ''Were you convicted (including plea of nolo contendre) of misdemeanor/felony)....?'' Can I truthfully say I was not convicted??

I have a different opinion on this. While I agree with Attorney Lebensbaum that your CWOF disposition required you admit to sufficient facts that could have supported a conviction, upon admiting to these facts your disposition was actually continued for a period of time without any resolution at all, at the end of which your case was dismissed and no conviction was entered. As a result, I believe the answer to the question is that you were not convicted.
