A QDRO is a Qualifed Domestic Relations Order. It is a document between the individual and the pension administrator authorizing an adjustment in distribution of benefits between a husband and wife as ordered by a divorce judgment. Retain an atoorney to help draft it. Good Luck!.

A QDRO is a Qualifed Domestic Relations Order. It is a document between the individual and the pension administrator authorizing an adjustment in distribution of benefits between a husband and wife as a result of a divorce. These documents can be somewhat complex and it is best to check with the retirement plan administrator as to any particular forms or required language. The document is generally reviewed and approved by the court also.

In a divorce, when someone's retirement account has to be split, you as the contributor cannot take out the money or else you will incur taxes and penalties. What a QDRO does is it lets the custodian of the account do the movement or transfer of money for you without incurring those taxes and fees.

QDROs are usually written by an attorney and approved by the custodian of the account and gets signed by the judge.
