The Right To Communicate With Parent of Child
My daughter is in custody of her mother, and we do not live together. She lives with another man. When I call to speak with her, he hangs up on me, or if she answers, he unpluggs the phone in the middle of converstaion. He has been known to be abusive, and very mean with vulgarity towards her. I know the phone is in his name. My question is: Do I have the right to call the local authorities to do a house call? I just want to know that her and the children are OK, and make plans to see my daughter on the weekends. Any response would be greatly appreciated.

You have the right to call the local authorities
to do a house call, but it is definitely
something you would regret doing after you did it.
Your question reveals that you anticipate that
the authorities would act with competence and
integrity. Generally they don't. Join the
CPSWatch listserv or visit Nev Moore's website (which deals with the DSS outrages)
and listen to the anguish of
those who have had to deal with these so-called social service agencies.
You would be better off getting a lawyer to
enforce your rights to visitation with the children
and perhaps even custody . . . if you feel the
children are in danger in their current living
condition.
A good lawyer would depose your wife and find out
EVERYTHING, which you could then use in court effectively.
