Legal Question in Family Law in Massachusetts

Custody of a child

I'm divorced and have physcail custody of my son who is nine. The father has always had vistation rights. However he now wants to take me to court for shared custody (he wants to pay less child support). What do I need to do to convince a judge that this would NOT be in the best interst of the child.

Re: Custody of a child

The court is unlikely to change to shared physical custody. Shared physical custody requires a degree of cooperation that most divorced parents cannot manage. If you have had the more traditional arrangement for a long period, it would take a great deal for your husband to -affirmatively- prove that shared physical custody -is- int he child's best interest.

My suggestion would be that you engage an attorney and consider filing a counterclaim for a child support review.

I have an office in your area, and would be happy to consult further.

Re: Custody of a child

Retain an attorney to oppose this and to counterclaim for a review of the child support . Good Luck!
