Legal Question in Family Law in Massachusetts

custody question

I have been separated/divorced from my ex husband since 6/97.I have physical/joint legal custody.

I have been involved with a very healthy relationship (discreetly) since my break up. My question is I would like to take my daughter(10) with me in November to the UK with my boyfriend. I need to know my rights, and also what my ex spouse may have. I know that he will get beligerant and start the name calling and verbal abuse that he does best. He is convincing and very threatening, I need somthing to back me up for the "argument " I know he will put me through when I break the news . I have kept my relationship not his business, and am not sure if he knows I have been with this same man for almost 4 years. I am tired of fearing my ex spouse, I want to move forward with my daughter, and my daughter and I want to stop living in the fear of how he wil respond when he learns of my relationship that is heading towards possibly remarriage. I desperately need your help in moving forward, I also have no money since our breakup left me penniless and with no equity, property, alimony. He got everything, I just wanted out. But please help me win this final battle.

Re: custody question

Your relationship with this person should be no business of your ex husband unless there is harm to the child. However, Massachusetts law does not allow the removal of a child from Massachusetts after the parents of the child have been divorced unless the other parent agrees or you get permission of a judge. If the trip is a visit (a week or two), this may not be a removal. However, the law is not clear on this point. If you violate this law, you could be charged with a crime of parental kidnapping.
