Legal Question in Family Law in Massachusetts
Dealing With DSS
There are many horror stories about the DSS's tactics. However, I was recently forced to file a complaint with DSS regarding neglect to my six month old son. During the phoned-in complaint the case worker voiced concern about the mother's neglect and her behavior in regards to trying to eliminate me, the father, from my son's life. My question is this: If the DSS opens a case against the mother of my child and decide to remove him from the home, can they immediately put him up for adoption without allowing me to have custody? Can I fight such an act by them in court?

Re: Dealing With DSS
If you have been determined to be the father you should get custody automatically if the mother can't have custody.
