Legal Question in Family Law in Massachusetts

My divorce stipulates that I provide health coverage for my ex wife till remarriage or death. It has been 15 years since our divorce and I have since remarried and she has not. Do I have to continue indefinitely paying for her coverage or can I go to the court to have the decree amended?

You should bring your divorce papers to a lawyer to interpret the insurance provision. Since you have remarried, you may not have to provide health insurance to her. Under Massachusetts law, if you remarry you can't carry her under the same policy as you. You can only carry her under a separate policy. A lawyer who is familiar with divorce and the laws relating to health insurance should be able to give you advice on this matter.

It depends on exactly what your agreement states - and whether that provision is even modifiable. You should have an attorney look at it. This is one of those issues that really depends on the language in the agreement.
