Legal Question in Family Law in Massachusetts
I was forced to defend a frivolous contempt case and it was just dismissed by opposing counsel because they admitted a mistake. I have a motion for attorney fees next date because I was forced to pay attorney fees to defend said complaint. My case is in probate court and I would like to know if Judge awards attorney fees who would be paid me or my lawyer? My lawyer is stating that i continue to fight my next case, she wants $10,000 to defend next case.

The award of attorney's fees is meant to reimburse you for attorney's fees you have paid. If you owe your attorney money, or have not yet paid her fees, then it would seem your attorney should get those funds, right? Your "next" case is separate from your previous case, and you will have to work out a fee arrangement that is acceptable to you both. $10,000.00 is about what I would need in the bank before agreeing to defend a case in District or Superior Court, so it doesn't sound patently unreasonable to me.
