Legal Question in Immigration Law in Massachusetts

I am applying for my I-140 and I-485 and am a current H-1B visa holder. In the AOS questionnaire, they ask about a prior criminal record in or outside of the US. My husband had a court case for cursing in public in his home country in 2002, and was charged with an obscene language fine ($42 USD). This appears on the back of his certificate of character in his home country (which we were not asked to provide as part of the I485 application. He would like to answer "no" to any prior convictions on the AOS questionaire. Can the biometric testing pull up this record? Should we disclose it on the questionnaire? Another question in the questionnaire asks if he has ever appeared at a police station for any reason. Please advise. If we omit the question, will his green card be denied later on?
