I am a us citizen. I want to file for my mom. My brother is 20. Can we include him on my mother's application? Will he get a green card also?

Hi,

Your mother is considered an immediate relative, and if she is currently in the U.S. she can adjust status without having to depart the U.S. if she initially entered the U.S. legally.

You can sponsor your brother in the 4th family preference category. It may take about 10 years for a visa to be available in the 4th family preference category. Additional information about family sponsorship categories is here: www.h1b1.com/sponsor.htm

Unfortunately, your 20-year old brother can't be included into the petition you file for your mother. No, he will not get a green card with his mother.

You will need to file a separate petition for a brother (doesn't matter his age, marital status). Minimum waiting time for a brother would be around 10 years (for most countries), and longer for several specific countries.
